When will CBSA start issuing monetary AMPS for the non-compliant freight forwarders?
The Canada Border Services Agency (CBSA) has announced in Customs Notice 21-15, they may start issuing monetary AMPS penalties as of July 5th to freight forwarders that are non-compliant with electronic house bill requirements. Freight forwarders must electronically transmit advance house bill data on consolidated freight to the CBSA within the timeframes specified by mode.
All carrier codes that you wish to transmit to the CBSA must be registered by completing the
ACI EDI Application Form. You are only permitted to send eHBL using your own carrier code or another client’s carrier code when an existing agreement is in place. If you are filing on behalf of another company and will be using their carrier code, the company must complete the form with you listed as their agent in Section 3 of the form.
CBSA is made aware of instances where another entities carrier code is used without authorization and administrative monetary penalties (AMPs) will apply.
In addition, CBSA reminds all users to ensure your contact information registered with the CBSA is up-to-date. Please refer to this
link which provides information on how to up-date contact information with the CBSA. Clients may reach out to the Commercial Registration Unit at
carrier-cargo@cbsa-asfc.gc.ca to up-date their contact information. This is very important. If CBSA has no way of reaching you regarding certain ACI transmission from failure to update contact information with the CBSA, it
may result in either a carrier code suspension or AMPs penalties C389 or C388.
