When should I use Orders In Council?

An Orders in Council Shipment is a Canadian shipment classification for goods clearing through the Canada Border Services Agency (CBSA). It permits the release of goods that are exempt from standard clearance processes due to an Order in Council.

An Order in Council is a specific type of legislation that may grant exemptions from regular clearance requirements for goods imported into Canada by highway carriers, which are not otherwise provided for in the Customs Act. To qualify, the conditions specified in the relevant Order in Council must be met, and the carrier must provide the Order in Council (OIC) number.

A commonly used Order in Council for highway carriers is the Courier Imports Remission Order, which allows for the release of shipments valued at 20 CAD or less, subject to certain restrictions, including those on alcohol and tobacco products. The OIC number for this Order is 85-2955.
