What if we filed an entry for a shipments that ACAS was not filed on time at origin , Will CBP goes after us for the penalty?

ACAS is generally the responsibility the inbound air carrier and/or other eligible ACAS filer . We are finding our customers who are freight forwarders/consolidators needing to file either to save costs as airline may charge them fees for filing high volume ACAS or for other reasons. I think it is an arrangement between the airline and the agent on who will be filing the ACAS for a particular shipment. End of day if ACAS is not on file, cargo cannot be loaded onto the aircraft which is bad for everyone.
